馬英九在二００八年當選後，就聲稱台灣只是一個地區，矮化台灣主權。事實上，即便台灣正式國名是「中華民國」，但在絕大多數國家辦理簽證時的國籍選項只有「TAIWAN」，而非Republic of China，更不是中國台灣省或中華台北。在去年ECFA議題發燒時，美國資深兩岸問題專家譚慎格於三月十三日指出，馬英九漸漸放棄「台灣是獨立的主權國家」的事實。譚慎格批評馬英九聲稱台灣是中華民國一小部分，領土竟包含蒙古、西藏、新疆與圖瓦共和國，完全脫離事實。

江國慶遭槍決的冤案，社會一片撻伐軍方聲浪，於是馬英九對人民的不滿表示會有作為，但能依刑法懲罰相關軍官嗎？不能！因為早已超過十年追訴期。

江國慶父親江支安，早在一九九六年十月就向監察院陳訴。江國慶在一九九七年被槍斃後，同年十二月，江支安繼續向監察院申訴。
一九九八年，曾任民進黨主席的監委江鵬堅和陳光宇接手調查，一九九九年公佈調查指出除被告自白外，均無證據證明被告涉案，且國軍法醫中心鑑定書缺失連連
等，然軍方依然不認錯。江支安繼續在一九九九、二○○一、二○○二年多次向監察院續訴。二○○四年底，監委張德銘、古登美等續查，並列為重大案件，但又因
為二○○五年二月監委任期屆滿後暫停。

接著，馬英九在擔任國民黨黨主席後，開始杯葛監委審查與提名，造成監察院空轉將近四年，使得監察院無法繼續處理江國慶案。

二○○六年十二月，王金平曾敦促馬英九讓監察院早點恢復運作，但泛藍在馬英九領導下，依然強悍地在立法院程序委員會不斷封殺包含監委和軍購在內的議
案；一直到馬英九在二○○八年上任總統後，才讓監察院恢復運作。然而，此時已經超過了追訴相關軍官刑事責任的十年追訴期；而這也是為何監委馬以工對此表達
遺憾，李復甸抨擊國民黨需負責的原因。

可笑的是，當監察院在馬英九的「同意」下，於二○○八年恢復運作時，馬英九在該年十二月表示他非常
認真看待五二○宣誓時的第一個承諾「余必遵守憲法」，因此儘速讓五權憲政機關順利運作，尤其是監察院空轉多年。只是，讓五權憲政無法運作的就是馬英九；如
今，馬英九更造成了台灣人民無法及時透過監察院追究枉法濫權的陳肇敏、柯仲慶、許應強、鄧震環、李書強、何祖耀等人的刑事責任。
